Wisconsin residency and timeline

Wisconsin is a no-fault state. You do not need to prove wrongdoing by your spouse. The only ground you state is that the marriage is irretrievably broken.

One of you must have lived in Wisconsin for at least six continuous months, and in your filing county for at least 30 days.

After you file and your spouse is served, there is a mandatory 120-day waiting period before the court can hold your final hearing.

While the case is pending, you can ask the court for temporary orders covering custody and placement, child support and spousal maintenance. These keep your children in a stable routine while the divorce proceeds.
Dividing marital assets and debts
Wisconsin follows community property principles. Assets and debts acquired during the marriage belong to both of you, regardless of whose name is on the title.
A judge can adjust the presumed 50/50 split after weighing factors including:
- Length of the marriage
- Age and health of each spouse
- Earning capacity, current and future
- Nonmonetary contributions to the marriage
- Any valid marital agreements
